Warranty, Returns & Site Terms

Trusty-Cook warrants all its hammers against failure in normal use (manufacturing defects) for a 2 year period. We do not warrant our tools against misuse, abuse or WEARING OUT. All warranty claims are subject to product review by Trusty-Cook. Warning: striking a cold hammer (below 38 degrees) may/will cause a cracking failure.

Shipping

If you are interested in next day delivery services or have a time critical need, please contact us via info@trustycook.com or toll free 877-240-2462 to make specific arrangements. Orders typically ship out same or next business day, but are not guaranteed, based on order volume and in-stock inventory.

We make every effort to ship orders quickly. Orders received after 12:00 pm EST, will not be shipped until the following day.

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. To complete your return, we require a receipt or proof of purchase.

There are certain situations where only partial refunds are granted: (if applicable)

• Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
• Any item that is returned more than 30 days after delivery

Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at info@trustycook.com.

Exchanges (if applicable)

We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at info@trustycook.com and send your item to the address below.

Typographical Errors

In the event that a Trusty-Cook product is mistakenly listed at an incorrect price, Trusty-Cook reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Trusty-Cook reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Trusty-Cook shall issue a credit to your credit card account in the amount of the incorrect price.

Term Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Trusty-Cook without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of Indiana, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Trusty-Cook products) shall be in the state or federal courts located in Indiana. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Trusty-Cook products) must be commenced within one (1) year after the claim or cause of action arises. Trusty-Cook’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Trusty-Cook may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Trusty Hammers or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
